AN ORDINANCE ESTABLISHING
VENDORS PLAZA AND JEEPNEY TERMINAL AT THE RECLAMATION AREA.
WHEREAS,
vending outside the markets has been a major concern of the city, it
being illegal and the cause of traffic congestion and the narrowing of
sidewalks reserved for pedestrians;
WHEREAS, the conversion of some
of city streets for jeepney terminals has also greatly contributed to
the traffic congestion problem of the City;
WHEREAS, among the causes of this recurring problems are: a) the number
of vendors is steadily increasing while venue for their market does not.
b) the city has not provided jeepney drivers with a terminal where they
could load or unload passengers;
WHEREAS, to address these concerns, the city has built structures to
accommodate a number of vendors and a terminal for jeepneys on the city
owned lot, with an area of 8,324 sq. m. at the Reclamation area;
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Bacolod
City in session assembled, that:
Section 1. Title. This ordinance shall be called as, “AN ORDINANCE
ESTABLISHING VENDORS PLAZA AND JEEPNEY TERMINAL AT THE RECLAMATION
AREA.”
Section 2.
Short name of the market and
jeepney terminal. The short name of the market and jeepney terminal
shall be known as the Vendors Plaza.
Section
3. Coverage. This ordinance shall exclusively govern the establishment,
administration and operation of the Vendors Plaza and Jeepney Terminal
established at the Reclamation Area.
Section 4. Rates. The following shall be the rates for the Vendors Plaza
Market and Jeepney terminal, including Restroom maintenance fee:

4.2
Terminal Fees shall be charged, as follows:

4.3
As an adjustment period, awardees shall be charged only fifty percent
(50%) of the regular market rental and terminal fees for the first six
(6) months. On the seventh (7th) month, all regular market
rentals and terminal fees provided in this ordinance shall be imposed.
Section 5. Awards. Awards shall be granted in accordance with the
procedures provided in the Market Code of 1996, however said awards
shall be subject to review and renewal every two (2) years.
Section 6. Supervision and
Control. In accordance with Section 5 of the Market Code of Bacolod
City, the City Administrator shall exercise direct and immediate
supervision, administration and control over government owned and
operated public markets and the personnel thereof, including those whose
duties concern the maintenance, upkeep, peace and order of the market
premises, except collectors in accordance with laws, local ordinances
and other rules and regulations pertinent thereto. This provision is
expanded to include the operation and management of the Vendors Plaza
with Jeepney terminal.
6.1 Creation of Positions, including Salary Grades for the positions of
Personnel in the Vendors Plaza. The following positions of personnel in
the Vendors Plaza shall be created, with corresponding salary grades for
full operation of the Vendors Plaza:

Section
7. Functions. Hereunder is the function of various personnel in
the Vendors Plaza, to wit:
7.1 Market Supervisor II
a)
Executes and implements
directives and policies emanating from the Market Supervisors III and IV
as promulgated by the
City Administrator,
pertaining to the operations and maintenance of the Vendors Plaza. As
such he or she must see to it
that sanitation, cleanliness, order
and good conduct are maintained inside the market and jeepney terminal
including and
all areas in the Vendors Plaza or
its immediate environs;
b)
Sees to it that all
stall holders in the market at the Vendors Plaza must be provided with
the corresponding official receipts
and
prescribed cash tickets, respectively, for the stalls and/or spaces
occupied by them;
c) Sees
to it that jeeps parked at the Terminal have secured the appropriate
tickets or corresponding receipts;
d)
Prepares
weekly statistical data on prevailing prices of goods in the Vendors
Plaza, including at the nearby business areas
for the information of the
City Administrator;
e)
Prepares
weekly report relative to the operation/activities of the Jeepney
Terminal, and submit the same to the City
Administrator;
f)
Supervises and evaluates
activities and performance of all Vendors Plaza subordinates personnel,
except market collectors
or
personnel involved in the collection/revenue function. He or she shall
likewise investigate complaints affecting the
performance
and functions of his/her subordinates; and
g) Perform
such other functions and duties that may be assigned by the Market
Supervisor III or IV and/or the City
Administrator.
7.2
Market Inspector II
a) Inspects
cash/official receipts or tickets issued to the stall holders/vendors or
the drivers/operators of jeepneys parked at
the jeepney terminal;
b)
Inspects
the sanitary condition and upkeep of the markets and terminal
facilities, and determine whether sanitary rules and
regulations
of the market are complied with;
c) Reports
to the City Administrator or his/her duly authorized representative any
deficiencies found during such inspection;
and
d)
Shall
report daily to the City Administrator or his duly authorized
representative for his/her instruction or his/her assigned
work and submission of reports.
7.3
Utility Foreman
a)
Reports to the Market
Supervisor II;
b)
Supervises/oversees
the work and needs of utility workers, whether regular or casual
assigned in the Vendors Plaza;
c) Takes
charge of utility workers by seeing to their needs and attending to
their complaints;
d) Relays
instructions of the Market Supervisor II; and
e)
Inspects the work of Utility
Worker and checks whether they work accordingly.
7.4
Plumber II
a)
Maintains,
repairs and inspects or checks all water line connections in the Vendors
Plaza and in all other public markets in
the
city which the Market Supervisors III and IV and the City Administrator
may be assigned;
b)
Monitors
and immediate repairs of water leakage in the Vendors Plaza and other
markets in the city. And reports illegal
connection to the Market
authorities; and
c)
Assists in the flushing
of Vendors Plaza market section and terminal by providing adequate water
supply.
7.5
Security Guard II
a) Provides
physical security services at Vendors Plaza premises;
b) Distributes
and collects pass cards of personnel;
c) Logs
persons and vehicles entering the office of the Vendors Plaza;
d) Assists
to control traffic;
e) Escorts
VIPs to proper destination;
f) Reports
to proper authorities unusual happenings at the Vendors Plaza;
g) Maintains
order within the immediate vicinity;
h) Assists
in fire-fighting; and
i)
Performs such other
functions as maybe assigned/ or required by the supervisor.
7.6
Electrician I
a)
Installs, maintains and
repairs of electrical lines or motors and wiring systems of Vendors
Plaza; and
b) Installs,
maintains and repairs of lightings and powerlines of Vendors Plaza.
7.7 Billing Clerk II
a) Maintains
for the City Administrator’s files, records to show the cash items
received everyday, the names of payees, and
other
official receipt numbers.
b)
Maintains the individual
ledgers of the market lessees and provides them with monthly billing
statements.
c) Keeps
working area neat, and regularly checks the security of the area, and
reports to proper authority when the need
arises.
d) Such
other responsibilities as the City Administrator may assign.
7.8 Utility Worker I
a) Daily
clean/sweep Vendors Plaza market and Jeepney Terminal;
b) Hauling
and dumping of garbage the Vendors Plaza;
c) Disposes
garbage at Vendors Plaza dumpsite; and
d)
Assists plumber in
weekly flushing of the Vendors Plaza, including all Markets and Terminal
floors and all areas in the
Vendors
Plaza.
Section 8. Miscellaneous Provision. For purposes of penalizing
acts of omissions not provided in this Ordinance, the present Market
Code of Bacolod City will prevail. Provisions of the Market Code which
are not inconsistent with the provisions of this ordinance shall apply
with respect to other matters, including restrictions, penalties, etc.
Section 9. Separability Clause. If any provision of this
ordinance shall be declared unconstitutional or invalid by any competent
Court, provision hereof which is not affected, thereby shall continue to
be full force and effect.
Section
11. Effectivity
Clause. This ordinance shall take effect immediately after publication
in local newspapers of general circulation.
